ALLEGED OFFENCES
Statement of Policy
If an allegation or complaint is made against an employee of the Peel District School Board, every effort will be made to protect the individual against injury to character or reputation resulting from the alleged offence.
Administrative Regulations
Step 1 - Informal
1. An opportunity will be provided for face to face discussion between the employee and the appropriate supervisor to discuss the complaint or alleged offence.
2. If it can be determined that the complaint or allegation is without substance and all parties agree, the issue will be discreetly terminated.
3. The majority of problems should be resolved at this stage of informal discussion.
Step 2 - Formal
If, in the opinion of any of the parties involved, the allegation or complaint is of a nature that warrants further investigation and might reasonably be anticipated to result in damage to character, reputation, demotion, suspension or dismissal, then the following procedure should be adhered to:
(a) The Director of Education or designate will conduct the investigation and will carefully document the complaint or allegation and all information pertinent thereto. Copies of the documented information will be provided to all parties to the issue.
(b) All concerned persons are to maintain confidentiality until the investigation is complete.
(c) Upon completion of the investigation, the employee shall have access to all documented information pertaining to the investigation.
(d) The employee shall have the right to counsel of his/her choice in discussion with supervisory personnel and the Board, In Committee.
(e) The employee and the appropriate supervisor should appear and be heard by the Board, In Committee before any final decision is made.
(f) If at this level of investigation it can be determined that the complaint or allegation is without substance and all parties agree, the issue will be discreetly terminated. If this is not the case, the issue will be referred to a Committee of the Board, headed by the Chair of the Board or designate.
This procedure shall be stayed until a charge being laid in the courts has been dealt with.
* An alleged offence is not to be construed as involving the professional competence of the employee.
